Approved Emergency Rule Change: An Order for the Prohibition of all Landscape Irrigation for all TKPOA Water Serviced Properties and Commercial Customers of the Tahoe Keys Water Company

Approved Proposed Rule Change Notification: to the Tahoe Keys Property Owners Association (TKPOA) / Tahoe Keys Water Company (TKWC) “Rules and Regulations for Water Service”’ for a Prohibition of all Landscape Irrigation for all Water Serviced Properties and Commercial Customers of the Tahoe Keys Water Company.

On March 11th, 2021, the TKPOA Board of Directors approved and adopted the attached Emergency Rule during the Open Board Meeting. Pursuant to Civil Code Section 4360 (d) an Emergency Rule Change to prohibit “all landscape irrigation” for all water serviced properties and commercial customers of the TKWC.

This emergency rule change shall be in effect for 120 days, from April 1st, 2021 – July 8th, 2021 per the TKWC memorandum dated February 28th, 2021 that documents the forecasted water shortage this coming summer due to current and potential further uranium contamination citations from the State Water Resources Board. This Order will extend to all TKPOA Common Areas, all Cove Townhome landscaping, all Single-Family home landscaping, and commercial water customer properties landscaping.

On March 11th, 2021, the TKPOA Board of Directors also approved the attached proposed Rule Change Notification to the “Rules and Regulations for Water Service”’ to be sent to all TKPOA Property Owners and Commercial Customers to begin the 28-day Rule Change review process.

The TKPOA Board has contracted with MC Engineering to address the capacity issues and are working towards providing an analysis to recommend a long-term facilities plan by June 2021 for next steps. The TKPOA Water Company Oversight Board Subcommittee and TKPOA Staff are working with MC Engineering are working on an expedited timeline to meet this June 2021 schedule.
